This Privacy and Information Security Policy ("this Policy") discusses the personally identifying information that we collect about you when you use our website https://smartxaas.io (the "Site") and the other services we provide on or through the Site (together with the Site, the "Service").

1. INFORMATION YOU GIVE US

a. The Types of Information SmartXaaS LLP™ Collects

We collect information you provide to us in several ways:

  • Information you enter directly on our Service
  • Information you send us via email, surveys, or letters

The information we collect depends on how you use our Service. When you register for an account, you must provide:

  • Username
  • Birthday
  • Email address
  • Password (created by you)

We may also ask for additional information like your first and last name, gender, and zip code.

b. Information in Public Areas of the Site

Important: Any information you share in public areas (like profile pages or forums) can be seen and used by others.

We recommend you do not share personal contact information in public areas, including:

From time to time, we may host a promotion, sweepstake, or contest on the Service. You may be asked to provide personal information or permit the transfer of your personal information to a third party in connection with such promotion, sweepstake, or contest. It will be disclosed at the point of collection or transfer who is collecting or transferring the information and whose privacy statement applies, and it will be your choice whether or not you wish to permit such transfer or our collection of personal information by a third party.

3. SmartXaaS LLP™'S USE AND RETENTION OF YOUR INFORMATION

Retention of Information

We retain information for as long as required, allowed, or as we believe it useful, but do not undertake retention obligations. We may dispose of information in our discretion without notice, subject to applicable law that specifically requires the handling or retention of information. You must keep your own, separate back-up records.

4. SmartXaaS LLP™'S SHARING OF INFORMATION

SmartXaaS LLP™ shares information with third parties, but only as described in this Section 4.

a. Advertisers and Others

We share non-personally identifiable information with advertisers, service providers, and other persons with whom we conduct business.

b. Service Third Parties

We contract with affiliated and non-affiliated third parties to provide services to us or to you on our behalf. Examples include providing marketing assistance, providing customer services, sending SmartXaaS LLP™ email to you, removing repetitive information from customer lists, and analyzing data. These third parties have access to personal information needed to perform their functions.

c. Business Transfer

As we develop our business, we might sell or buy businesses or their assets, or engage in acquisitions, mergers, restructurings, changes of control, or similar transactions. In such transactions, customer information generally is one of the transferred business assets, and your PII is subject to such a transfer. Also, in the unlikely event of a bankruptcy, customer information may be transferred to a bankruptcy trustee or debtor in possession and then to a subsequent purchaser.

d. Compliance and Safety

We may release user information when we believe release is appropriate to:

  • comply with applicable law, and to respond to legal process, including subpoenas, search warrants and court orders, and to respond to or otherwise address written complaints of copyright infringement;
  • make disclosures under programs intended to prevent potential crimes or investigate persons;
  • enforce or apply agreements, including the Terms; or
  • protect the rights, property, or safety of SmartXaaS LLP™, our users, or others, including exchanging information with other companies for fraud protection and credit risk reduction.

5. INFORMATION SECURITY

a. Your Obligations

Your security responsibilities:

  • Protect your password and computer from unauthorized access
  • Sign off when using shared computers
  • Do not include sensitive information in emails to us
  • Be suspicious of emails asking for passwords (we will never ask for this)

Important: You must take reasonable steps to protect your personal information.

b. Our Security Measures

We have physical, electronic, and managerial procedures to help safeguard, prevent unauthorized access, maintain data security, and correctly use your information. HOWEVER, WE DO NOT GUARANTEE SECURITY. Neither people nor security systems are foolproof, including encryption systems. In addition, people can commit intentional crimes, make mistakes or fail to follow policies. If applicable law imposes any non-disclaimable duty (if any), you agree that intentional misconduct will be the standards used to measure our compliance with that duty.

6. LINKS

The Service contains links to other sites. We are not responsible for the privacy practices of such other sites. We encourage you to be aware when you leave our Site and to read the privacy statements of every web site that collects your personally identifiable information. This Policy applies only to information collected by the Service.

7. CHOICE

Required communications: We will send you essential business messages that you cannot opt out of, including:

  • Account acceptance/rejection notices
  • System and administrative messages
  • Address confirmations
  • Transaction information

Optional communications: You can choose not to receive other types of messages, such as:

  • Friend requests
  • Daily emails from SmartXaaS LLP™

How to opt out: Go to the Profile tab on our Site and edit your email preferences.

8. ACCESS AND RECORD KEEPING

Information relating to our programs is not necessarily maintained in a retrievable form. However, you may make changes, corrections, or updates to some PII provided through the Service that we use for communications with you by going to the "Profile" tab on the Site. We may keep a record of all information that is changed. We may determine what may be changed. For example, if we are required to keep track of certain kinds of transactions, you may be prevented from changing relevant information.

9. CONDITIONS OF USE, NOTICES, AND REVISIONS

a. Privacy Concerns

Your use of the Service and any dispute over privacy is subject to the Terms of Service. If you have any concern about privacy at SmartXaaS LLP™, please send us a thorough description to [email protected], and we will try to resolve it. If you think we are in default of the Terms, you may contact us at Our Legal Notices Address in Section 10 below.

b. Notice Required by Law

In those jurisdictions that permit email notice, if we are required to disclose or provide notice of invasion of certain security systems, we will do so by email to the most current email address provided by you to us. It is critical that you keep your email contact information correct and updated with SmartXaaS LLP™ at all times.

c. Identity Theft

If you believe that you are a victim of identity theft entitled by law to request information from us, write us at our Legal Notice address (see the next section of this Policy) and we will let you know what additional information you must provide to us. After we have received that information, we will supply without charge the information legally required to be disclosed that we then have, subject to applicable law and reserving all of our rights and defenses.

#Refund Policy

1. General

This is the refund policy of SmartXaaS LLP™, (hereinafter referred to as "SmartXaaS LLP™") which applies to all SmartXaaS LLP™ websites and services.

This refund policy of SmartXaaS LLP™ is intended for all users of the SmartXaaS LLP™ websites and services ("user"). The SmartXaaS LLP™ services are digital in nature and hence once the delivery of the service/campaign is complete then it is not reversible thus refund are only possible in special cases as discussed further.

  • No refund can be processed for change of business plan at the client's end. In the event a customer has paid for a service and then requests for a refund only because there was a change in mind, the refund shall not be considered as there is no fault, defect, or onus on SmartXaaS LLP™.
  • The Refund shall be only considered in the event there is a clear, visible deficiency with the service or product purchased from SmartXaaS LLP™.

Note: Refund turnaround time is generally 24 hours or instant but may take up to 5-7 days on an average depending upon the payment method.

2. Payment Refund

2.1 Refund on Invoices:
If the user has added funds to their Wallet Balance and unused then you may ask for the refund as per the following:-

  • If asked same day, a full refund minus gateway fee (min: $1 or ₹50) will be applicable.
  • If asked next day, a full refund minus 10% handling+gateway+markup fee (min: $1 or ₹50) will be applicable.

Please find some exceptions below:-

  • No refund, if funds associated with the invoice are used either partially or fully i.e user must not use their funds for purchasing any services such as creating campaigns or placing orders.
  • No refund, if payment was made by wire or bank transfer or cryptocurrencies or any non-instant payment method/gateway.
  • No refund, if payment was made by gateways that don't have the facility to refund the transaction.

2.2 Refund on Campaigns/Orders:
Refund associated with campaigns/orders will be given to your Wallet Balance only. If you do NOT want to continue with the campaign/order then you may terminate/cancel it (if applicable and available) the remaining budget will get refunded back to your Wallet balance.

Please find some exceptions below:-

2.3 Refund on Wallet Balance
Wallet balance is non-refundable;

  • If you have USD Balance, you may exhaust it by running CPC or CPI or CPA campaigns.

3. Payment Disputes & Chargebacks

You must not dispute PayPal directly, without contacting the support team first. You may use PayPal dispute at the end when you are not satisfied with the resolution given by support team but you must first contact support in any case and explain your problem or justify the need for the refund.
Note: make sure you must wait for the response /resolution by the support team after you reach us.

If you dispute PayPal directly without contacting support first or waiting for a response/resolution from them then you may become ineligible for any refund from our end at all because in that case you have breached our policy by going against to it. Please note that If you contact support then your problem will be solved as soon as possible, but PayPal dispute will delay it upto 10 times or more than 30 days. Its better to contact support and get resolution faster and smoother.
